Terms and conditions

If you're an organiser or a professional, you have your own terms: Terms for organisers and Terms for professionals.

1. Purpose and acceptance

These Terms govern the use of VEMAX Sport (hereinafter, "the Platform"), operated by the entity identified in the Legal notice. By creating an account, you accept these Terms in full. If you do not agree, you must not use the Platform.

2. What VEMAX Sport is (and isn't)

VEMAX Sport is an intermediation platform (marketplace): it connects players with independent organisers of sports camps, clinics and tournaments, and facilitates publishing events, managing registrations and collecting payment through an external payment provider (Stripe).

VEMAX Sport does not organise, provide, supervise or run any camp, clinic or tournament. Each event published on the Platform is independently organised and provided by the organiser who publishes it, who acts on their own behalf and not as an employee, agent or representative of VEMAX Sport.

3. Organiser's responsibility

Each organiser is solely responsible for:

  • The content, description, price and conditions of the event they publish.
  • Holding the licences, permits, civil liability insurance and any authorisation required under applicable sports, health and child-protection regulations.
  • The actual organisation, execution and running of the event: facilities, coaching and support staff, safety measures, and the supervision and care of participants, including minors.
  • Any incident, injury, damage or loss occurring before, during or as a result of the event.
  • Complying with the cancellation and refund policy that they themselves set and that is shown to the player before registering.

The player contracts their participation in the event directly with the organiser. VEMAX Sport is not a party to that contractual relationship, without prejudice to acting as an intermediary in collecting payment.

4. Physical and sporting risk

Taking part in a camp, clinic or tournament involves physical exertion and a risk inherent to sports practice (injuries, falls, overexertion and similar). You register voluntarily and at your own risk, and must follow at all times the safety rules, the instructions of coaching staff, and the access conditions set by the organiser and by the venue where the event takes place.

If you have any medical condition relevant to the activity, it is your responsibility to inform the organiser before the event and to make sure your state of health allows you to take part.

5. Professionals directory

The Platform includes a directory where adult sports professionals (coaches and, where applicable, other professional roles) may voluntarily publish a profile to promote themselves, and where organisers can contact them and publish collaboration offers.

What the "documentation reviewed" seal means. Before publishing a profile, VEMAX Sport reviews the federation licence documentation provided by the professional (the document and the declared number) and records this with the wording "[Federation] licence documentation reviewed on [date]". This statement is exclusively a factual statement about that review and that date: that a document with that information was submitted and examined. It does not mean VEMAX Sport has confirmed its authenticity with the relevant federation — no public register exists for that purpose —, it is not an assessment of the professional's quality, competence, experience or suitability, it does not amount to a recommendation, endorsement, certification or guarantee by VEMAX Sport, and it does not imply an employment, agency or dependency relationship between the professional and VEMAX Sport.

The rest of the profile's content (bio, experience, qualifications and other information) is written and updated by the professional themselves, under their own responsibility. VEMAX Sport does not verify that content.

Relationship between the parties. Any agreement, engagement or collaboration arising from the directory or a published offer is entered into directly between the organiser and the professional. VEMAX Sport is not a party to that relationship, does not take part in its financial or employment terms, receives no commission from it and is not liable for its performance. Each party is responsible for complying with the applicable labour, tax, sports and child-protection regulations, including — when the work involves regular contact with minors — checking any legally required certificates.

Removal of profiles and offers. A profile automatically stops being visible when its licence expires. VEMAX Sport may also remove a profile or an offer from the directory, without prior notice, where there are reasonable grounds to believe the information provided is false or is no longer accurate, where these Terms are breached, or where applicable regulations require it.

Permitted use of the directory. Data published in profiles may only be used to make professional contact through the channels offered by the Platform. Mass or automated scraping, reuse to build databases, and use for unrelated advertising or promotional purposes are prohibited.

6. VEMAX Sport's responsibility

VEMAX Sport's responsibility is limited to the Platform working correctly as a technological tool: reasonable website availability, correct management of registered sign-ups and of payment intermediation through Stripe, and compliance with its own obligations as data controller (see the Privacy Policy).

VEMAX Sport is not liable for the suitability, quality, safety or lawfulness of events published by organisers, nor for damages or losses arising from their organisation or execution. This limitation applies to the fullest extent permitted by law and does not affect rights that consumer protection law (TRLGDCU) or other mandatory regulations grant to the player and that cannot be excluded by contract, nor VEMAX Sport's liability for its own wilful misconduct or gross negligence.

7. Payments, commission and refunds

Payment for paid registrations is processed through Stripe. VEMAX Sport never stores card details. VEMAX Sport retains a commission on each paid registration (disclosed to the organiser when creating the event) for the intermediation service; the rest of the amount is transferred to the organiser.

Each event displays its own cancellation and refund policy, set by the organiser, which the player must accept before paying. If the organiser cancels the event, 100% of the amount paid is automatically refunded (including VEMAX Sport's commission).

8. Minors

Registering a minor requires the express consent of their mother, father or legal guardian, given on the registration form itself. The guardian is responsible for the accuracy of the information provided.

9. Your account

You are responsible for keeping your password confidential and for all activity carried out from your account. You must provide truthful information and keep it up to date.

10. Conduct and acceptable use

When using the Platform, you agree not to provide false information, not to impersonate another person or entity, not to publish or use unlawful content, not to use other users' data outside the purpose for which it was provided, and not to mass-extract, copy or reuse the Platform's content in an automated way (scraping).

Breaching this section may result in your account being suspended or terminated, without prejudice to any other action that may apply.

11. Intellectual property

The VEMAX Sport brand, and the Platform's design and code, belong to VEMAX Sport. The content of each event (description, images, logo) belongs to the organiser who publishes it.

12. Changes

VEMAX Sport may update these Terms. Significant changes will be notified by email or via a notice on the Platform before they take effect.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, both parties submit to the Spanish courts with territorial jurisdiction under the Spanish Civil Procedure Act (LEC). If you qualify as a consumer, you may in any case bring proceedings before the courts of your own domicile, under article 90.2 of the Spanish Consumer Protection Act (TRLGDCU).
